Jurisprudence - Text and Readings on the Philosophy of Law FROM THE PUBLISHER
The First Edition of Jurisprudence: Text and Readings on the Philosophy of Law was published in 1973 and has been a popular collection of materials on traditional schools of jurisprudence. The Second Edition retains many of the classic readings from the First Edition that are essential to an understanding of the development of legal philosophy. Extended readings from Aristotle, Aquinas, John Austin, John Locke, Thomas Hobbes, David Hume, Hans Kelsen, O.W. Holmes and the American Legal Realists are still part of the Second Edition. The materials from traditional schools of jurisprudence have been enhanced with excerpts from the words of Immanuel Kant, Jeremy Bentham, Rudolf von Jhering, Francois Geny, Henry Sumner Maine, Roscoe Pound, Lon Fuller and H.L.A. Hart that are new to this edition.
The Second Edition also reflects new scholarship and concerns in contemporary legal philosophy. New readings include representative excerpts from new perspectives on the philosophy of law, including Critical Legal Studies, Feminist Jurisprudence, Critical Race Studies, and Law and Economics. Contemporary legal philosophers chosen for extended treatment include John Raws, John M. Finnis, Joseph Raz, Ronald Dworkin, Duncan Kennedy and Richard A. Posner. Judicial decisions have been included that stimulate thought upon the consequences of applying particular jurisprudential principles in specific cases.
Each chapter of Jurisprudence: Text and Readings on the Philosophy of Law, Second Edition is preceded by an introduction that places each group of readings in their historical context, explores the principal features of the philosophies represented in the readings, and provides pertinent biographical information concerning the leading philosophers of law. Notes and comments after the readings are designed to elicit responses from the reader and to direct the reader to other scholarly commentary related to the readings. An introductory chapter explores some basic issues and concepts of the philosophy of law and concludes with a case on the Fugitive Slave Law that causes the reader to focus inescapable upon the very nature of law and of a legal system.
