A developer who was denied permits to build houses on pilings on a Seattle shoreline has no right to compensation for a regulatory taking, the 9th U.S. Circuit Court of Appeals in San Francisco has ruled. The property in question was on the shore of Elliot Bay near a city park and a marina. The land is classified as a first-class tideland and is completely submerged for half of each day.
